Timescales

For a Grant of Probate where inheritance tax is not payable, we anticipate the likely timescales to be in the region of three to six months, from initial instructions through to distribution of the estate.

As part of the process, we will take steps to contact any asset holders to ascertain the value of the estate. We will also take steps to repay any liabilities due from the estate, such as funeral fees.

Once the value of the estate is known, we will make an application to the Probate Registry for a Grant of Probate. In relation to estates where inheritance tax is due, this is required to be paid before a grant if probate can be issued.

Thereafter an Estate Account will be prepared, and the estate distributed in accordance with the Will. For Intestate Estates (where there is no Will) the estate will be issued in accordance with the Rules of Intestacy.
